Illegal goes to jail for multiple offenses
GOOD, but we get stuck paying for it. Bad.
"I'm not going to send you to the maximum 10 years under the statute, but I am going to double the maximum 16 months under the guidelines and sentence you to 32 months," Wingate said to Andrade, who had an interpreter at his side.
Wingate said he was taking into consideration Andrade's actions the night of his arrest.
The two Jackson police officers who arrested Andrade on Sept. 28, 2007, testified he attempted to fight them and said he wasn't going to go to jail. He was subdued with pepper spray.
Arresting officer Kevin Nash also said Andrade tried to bribe him by offering money if he didn't arrest him.
Nash said he didn't charge Andrade with attempted bribery.
Andrade was charged with driving under the influence, no driver's license, no proof of insurance, disregard of a traffic light, disorderly conduct and resisting arrest.
During the traffic stop near Woodside Drive and McDowell Road, a handgun was recovered.
Immigration and Customs Enforcement was called, and no record could be found of Andrade being processed for entry into the U.S. There are only two ways into this country: The right way and the wrong way. But immigration still grants refugee status to some of those that sneak in. Cubans, for example.
